Judge backs USDA in GIPSA rule withdrawal

A federal appeals judge in St. Louis has rejected a lawsuit that challenges the USDA’s withdrawal of GIPSA rules.

The court denied the petition filed in late 2017 by OCM, the Organization for Competitive Markets.

The GIPSA rule, proposed by the Obama administration, would have allowed producers to claim unfair prices and sue packers, feedlots and other producers. The USDA argued there would have been an explosion of litigation. The court agreed.
