Court rejects farm groups’ effort to stay EPA ban on chlorpyrifos

A federal appeals court has rejected an effort from ag groups to stay EPA’s ban on chlorpyrifos for food tolerances, which went into effect last month.

The 8th U.S. Circuit Court of Appeals turned down multiple requests from farm groups this week because of lack of jurisdiction.

Several groups, including vegetable and fruit growers, say the ban causes economic harm and argue that for many pests there isn’t a substitute.

The grower coalition says it’s inappropriate and not consistent with the law for EPA to revoke the tolerances of chlorpyrifos.

Last year, the 9th Circuit Court of Appeals ruled EPA had to revoke or modify the food tolerances to comply with federal guidelines.
