Arkansas sued by plant-based food company

An Oregon plant-based food company is suing the state of Arkansas over a law that bans using meat related terms to describe plant-based food products.

Tofurky and the American Civil Liberties Union filed a federal lawsuit Monday saying the law goes against their freedom of speech.

The Arkansas law went into effect this month and carries a fine of $1,000 per violation.

The ACLU says the government should focus on real consumer protection problems rather than protect special interests.

The ACLU and Tofurky are also suing Missouri. Settlement talks broke down earlier this month and the case will likely go to trial.

South Dakota has passed a similar labeling law as have Louisiana, Montana, Oklahoma and Wyoming.

Illinois-based Upton’s Natural Co. and the Plant Based Food Association are in litigation with Mississippi.
