Walmart sued for organic egg claims

A class-action lawsuit accuses Walmart of deceiving customers by selling organic eggs that were raised by hens in enclosed structures.

The lawsuit says Walmart used labels stating chickens had access to the outdoors, but they were instead raised inside by Cal-Maine Foods.

The USDA requires that organic livestock have year-round access to the outdoors. The lawsuit says even though the enclosed structures had screens to let air in, the theoretical ability to view the outdoors is not the same as having access to it.

Last month, the USDA announced that it intends to withdraw the proposed organic livestock and poultry practices rule that would amend requirements and clarify what it means for chickens to have access to the outdoors.

The law firm of Hagens Berman, in Seattle, Washington, filed the lawsuit in the U.S. District Court for the Northern District of California on behalf of consumers. The firm is seeking reimbursement for consumers.

  • And what exact loss have consumers suffered?

    Maybe because the chickens could not be outside and peck through one anothers droppings, the eggs didn’t quite have that special flavour?

    Good luck putting a dollar value on that !!
