R-CALF wins Montana Beef Checkoff case in court

R-CALF USA says it has won its fight against the “involuntary collection” of Montana Beef Checkoff funds that it says amounts to a tax.

In a news release, R-CALF says the federal district court of Montana on Wednesday affirmed a previous ruling that the USDA’s beef check-off program violates the first amendment to the constitution. The court put a preliminary injunction in place banning the private Montana Beef council “from retaining beef checkoff funds without the payers’ consent.”

According to R-CALF, the court ruled that “the USDA does not control how the (private) Montana Beef Council spends the money it obtains” from the federal checkoff program.
