Pork industry supports guest workers building ag facilities

The National Pork Producers Council has defended the use of H-2A agricultural workers for constructing hog barns and similar facilities.

NPPC filed a brief with the U.S. Supreme Court in the Signet Builders versus Vanegas case, where Vanegas filed suit alleging that even though he was building hog barns, he wasn’t an agricultural employee for purposes of the Fair Labor Standards Act.  NPPC believes that the construction of barns and other infrastructure is an essential and fundamental agricultural activity. They say the case affects the ability of agricultural businesses to hire workers on H-2A visas and both the amount and type of work that those workers can perform.

Wisconsin’s U.S. District Judge James Peterson dismissed the case, but it has been appealed to the U.S. Supreme Court.
