NPPC expects Prop 12 decision soon

The chief legal strategist for the National Pork Producers Council says the U.S. Supreme Court could soon make a decision on Proposition 12.

Michael Formica tells Brownfield he’s expecting a decision before the end of the first quarter. “I think because of when we were heard, a late February or March timeframe is likely,” he said Wednesday at the 2023 Iowa Pork Congress in Des Moines, Iowa.

Proposition 12 would make it illegal to sell pork in California unless the animal is raised in a specific manner. NPPC presented oral arguments in October.

Formica says he’s cautiously optimistic the court will rule in favor of NPPC.

“We have a very good chance of having a favorable decision, but you just can’t tell,” he said. “We are not in the room with them, and we don’t know what they are debating. We can only guess what their concerns are.”

He says the case would be sent back down to the lower court if the decision favors the pork industry.
