Injunction stops WOTUS Rule in 24 more states

A federal judge in North Dakota has issued a preliminary injunction to block the Biden administration’s Waters of the US rule from being implemented in 24 states.

Mary Thomas Hart, chief counsel with the National Cattlemen’s Beef Association says this is good news for America’s farmers and ranchers.  “Now, we are in total, up to 26 states that are not directly impacted by the Biden WOTUS rule,” she says.  “At least through the duration of the litigation on the legality of the rule.

She tells Brownfield the preliminary injunctions combined with the bipartisan resolution to disapprove WOTUS should send a clear signal to the Biden administration. “But it went to President Biden’s desk and he vetoed it,” she says.  “Saying that this rule provides necessary clarity for small businesses, including farmers and ranchers.  That’s a statement that we wholeheartedly disagree with.  We’ve made that very clear to the administration.”

Hart says she anticipates a ruling on Sackett v. EPA soon.  The Supreme Court heard oral arguments in the case in October.  Its ruling will decide how the agency defines the Waters of the United States under the Clean Water Act.  “Traditionally we’ve gotten those really big Clean Water Act decisions in April,” she says.  “So I will not be surprised if we get that opinion at the end of the month.”

She says the Supreme Court has nine days left on the calendar this month to issue rulings and it could come as early as Friday.
