Impact of WOTUS replacement muted by state regulations

The CEO of the Minnesota Pork Producers suggests the rolling back of the Waters of the U.S. Rule will have minimal impact in certain states.

David Preisler tells Brownfield while replacing WOTUS provides more clarity, states like Minnesota can still go over and beyond federal regulations.

“So I think one of the things we need to make sure is perfectly clear is that this does not roll back any sort of state-implemented water protections. So as we look at Minnesota, quite honestly I don’t think we’re going to see a whole lot of change under this new rule.”

But, Preisler is still grateful the Trump Administration addressed WOTUS.

“There were some things that really didn’t make a whole lot of sense within that federal rule (like) getting down to literally mud puddles that may have been in a yard. So I think it just got really extreme in the way it could be interpreted.”

The controversial WOTUS rule has been replaced by the Navigable Waters Protection rule that the National Pork Producers Council says is written in a way that would be defensible in court challenges.
