Federal Court hears Idaho hemp case

A Federal Court of Appeals heard from Idaho prosecutors Wednesday who say there is a gap between the USDA approving industrial hemp in the 2018 Farm Bill and providing movement regulations between states.

“This product cannot, in Idaho’s view pass through Idaho, right?”  “At this moment in time, until the subtitle G regulations are in place, correct.” 

Prosecutors argued Big Sky Scientific, a Colorado-based CBD distributor, acted too soon after the farm bill was approved and didn’t reach out to officials before transporting hemp through Idaho where it’s still illegal.

“This is very unusual.”

The Defense claims Idaho is overstepping the farm bill’s commerce clause which should protect the movement of legally produced hemp from one state to another.

“If it’s allowed to happen, it’s going to continue to happen despite what Congress has directed.”       

One judge said trying the driver with criminal charges before an interim decision is made gives him great pause in making a decision.

A shipment 6,700 pounds of hemp grown in Montana was seized in January on its way to Colorado and the case could set precedence for future interstate movement of hemp.
