EPA will update WOTUS rule

The Environmental Protection Agency is amending their updated Waters of the United States rule to keep consistent with the U.S. Supreme Court’s ruling in Sackett vs. EPA.

The agency made a formal request to stay a pending case in a U.S. District Court in North Dakota saying to wait until the new rule is written.

The lawsuit, led by the American Farm Bureau Federation, says the latest rule is a federal overreach and would be costly for states to comply.

In a statement to Brownfield, EPA says the agency and Army Corps of Engineers plan to issue a final rule by September 1.
