EPA rescinds guidance on Maui clean water ruling

The EPA has removed Trump administration guidance on a Supreme Court case about the Clean Water Act.

EPA’s assistant administrator says the previous administration’s guidance on the County of Maui versus Hawaii Wildlife Fund reduced clean water protections by creating a new factor for determining pollution discharges. The EPA says the guidance handed down January 14th skewed the analysis that could lead to increased discharges into a water of the United States.

EPA says the Supreme Court’s decision in that case and the Clean Water Act itself provide important protections for the nation’s waters “by ensuring that discharges of pollutants to groundwater that reach surface waters are appropriately regulated.”
