Environmental groups want dicamba lawsuit stay lifted

Environmental groups have asked the U.S. District Court of Arizona to again consider removing EPA’s registration of dicamba products. 

The Center for Food Safety and the Center for Biological Diversity filed a motion for an expedited hearing in their case against EPA and Bayer Cropsciences, referring to EPA’s December 21^st report they claim acknowledges EPA’s 2020 dicamba registrations do not comply with the Federal Insecticide, Fungicide, and Rodenticide Act, or FIFRA.

The court document claims EPA relied on the same label restrictions that allowed “enormous and unprecedented damage” and that EPA’s newest restrictions resulted in little change in the number, severity, or geographic extent of dicamba-related incidents.

The Center for Food Safety’s George Kimbrell issued a statement claiming EPA’s December report shows harm to their interests and the environment at large.  He says EPA’s measures and Monsanto’s empty promises have again failed, and that their lawsuit should be allowed to proceed so they can do EPA’s job of ensuring that over-the-top dicamba use does not continue to harm agriculture and the environment.

The lawsuit against EPA and Bayer has been stalled since the court granted a stay last July to allow the courts to determine jurisdictional issues after some dicamba lawsuits were consolidated.
