Department of Labor to review wage rates for H2A workers

The Department of Labor says it’s reviewing how it will determine wage rates for seasonal foreign workers in the H-2A visa program.

DOL says it wants to revise the process that it uses to calculate hourly Adverse Effect Wage Rates (AEWR).

The agency says it wants an adequate supply of legal ag labor and to protect wages and working conditions for similar employees.

The proposed regulations will rely on the Farm Labor Survey to establish the rates according to the process that the Department of Labor has used for the last 30 years.

Comments on the proposed rule can be submitted on or before January 31, 2022.
