Appeals Court declines to block sale of Corteva Enlist

A federal appeals court will allow the continued sale of Corteva’s Enlist DUO herbicide. Two judges on a three-judge panel of the 9th Circuit court rejected the claim by environmental groups that the EPA failed to properly consider the volatility or drift of the product.

The judges said the EPA properly used studies that show 2,4-D choline salt won’t cause damage to the environment.

The groups, including the Center for Biological Diversity and the Center for Food Safety, wanted the EPA to vacate the registration of Enlist DUO herbicide saying the volatility of the product harms the environment and endangered species.

In June, the Ninth Circuit court did order the EPA to pull registration for three dicamba products including Corteva’s FeXapan.
