WOTUS withdrawal resolution introduced in Senate

Two Midwestern senators have introduced a resolution calling on EPA to withdraw the Clean Water Act (CWA) rule, also known as Waters of the U.S. or WOTUS.

Senators Deb Fischer of Nebraska and Joni Ernst of Iowa say the resolution signifies their intent to roll back the rule once the new administration takes office.

In a joint statement, Fischer and Ernst say the Clean Water Act is critical to protecting water resources, but the final WOTUS rule goes too far, “blatantly violating the original intent of the CWA”.  Fischer calls WOTUS “completely unprecedented”, while Ernst calls it a “power grab”.

Implementation of the WOTUS rule is still on hold. In October 2015, a federal appeals court issued a stay blocking implementation of WOTUS nationwide.
