AFBF asks US Supreme Court to hear water case

The American Farm Bureau has filed a petition with the U.S. Supreme Court to stop, in its words, the EPA’s abuse of Clean Water Act powers.

AFBF’s General Counsel, Ellen Steen, says they want the high court to hear arguments against a lower court ruling that gives EPA “broad powers to micromanage local water runoff – EPA has no business dictating land use and deciding these intensely local matters.”

The lawsuit grew out of the EPA’s plan for restoring the Chesapeake Bay. Steen says Farm Bureau supports cleaner watersheds nationwide – but their process is wrong. She says Congress has deemed states have the power to plan for clean water goals and the power to change them.
