Dow responds to court decision in bee case

beesDow AgroSciences says it is considering options for challenging a federal appeals court decision affecting some of its insecticide products. The Ninth district court in San Francisco says federal EPA regulators should not have allowed the insecticides containing sufloxaflor onto the market because important information about them was lacking.

The lawsuit was filed by Earthjustice on behalf of bee industry groups which say the insecticide is highly toxic to bees.

In a statement, Dow said it “respectfully disagrees” with the court’s decision but will work with the EPA to implement the order and to provide the additional data to the EPA that the court is calling for “to support the registration of the products.”

On its website, the EPA says the restrictions it put in place for application “will protect bee colonies from harmful exposure.” The products are used to combat cotton and soybean pests, among others.
