Injunction is a step in the right direction

The Obama administration says it will begin implementation of EPA’s Clean Water Rule, commonly known as Waters of the US, today even though a federal judge in North Dakota issued a preliminary injunction temporarily blocking its implementation.  According to The Hill, the administration argues that the decision only applies to the 13 states requesting the injunction.

Indiana Farm Bureau president Don Villwock says even though the ruling out of North Dakota only applies to those 13 states – it is a step in the right direction.  “It’s very positive to get a court ruling that identified the flaws of the Clean Water Rule,” he says.  “I say it (the Clean Water Rule) is the largest land grab in the history of the United States.  To me it’s big that EPA could potentially have jurisdiction over every farm in the country that ever has a raindrop fall on it.”

Indiana Attorney General Greg Zoeller joined the suit in the District Court for the Southern District of Georgia in July.  That judged declined to block the rule – stating she lacked jurisdiction to rule on the injunction that 11 states, including Indiana, requested.
