State Ag Departments ask for voluntary delay of WOTUS

The U.S. District Court for the Northern District of West Virginia confirmed to Brownfield Ag News that it has denied a request to block Friday’s implementation the federal Clean Water Rule, commonly known as Waters of the U.S.  The request for the injunction was brought by Murray Energy.  The matter is still under consideration by judges in North Dakota and Georgia.

Meanwhile, the association representing state agriculture departments is asking the EPA and U.S. Army Corps of Engineers to voluntarily delay implementation, which is set for Friday.  The National Association of State Departments of Agriculture says more time is needed to brief not only state agencies and those being regulated, but also EPA and Corps field staff.  In its letter, the NASDA says the rule “creates significant confusion among state regulators and the agriculture community.”
