Judge says GMO seed moratorium invalid

Programs ICONA federal judge has struck down a voter-approved ban in the state of Hawaii on GMO seed work. The judge overturned the GMO moratorium passed by voters in November that would have made it illegal to grow or test GMOs in Maui County – until the seeds are “proven safe.”

The judge said the moratorium was not enforceable and was invalid because state and federal law preempts it.   Dow AgroSciences and Monsanto have research farms on more than three-thousand acres in Maui County.

Similar measures were struck down in court last year on the islands of Kauai and Hawaii.
