Wisconsin farmer challenges raw milk law

It is up to the Sauk County District Attorney as to whether charges will be filed against a Wisconsin farmer for selling raw milk. State officials shut-down Vernon Hershberger’s operation on Wednesday because the dairy farm does not have a license to sell milk and does not have a license to operate the store he was running three days a week on the farm…selling raw milk and raw milk dairy products. Hershberger says he is exempt from the law because the store is open only to members, not to the general public.

Earlier this year, the Wisconsin State Legislature passed a bill which would have temporarily legalized the sale of raw milk from farmers direct to consumers. Governor Jim Doyle vetoed the bill citing strong opposition from the dairy industry and health industry. However, had the Governor signed the bill it would not have applied to Hershberger because one of the requirements was that the producer have a valid state license to sell milk, Hershberger did not renew his license in February.
